Customer Returns AS IS Purchase Agreement and Disclosure
1) I have agreed to purchase items described as customer returns directly from RhinoMart's website. I understand RhinoMart's definition of Returns, Customer Returns, and untested Returns as being items that were previously purchased from a retail store chain, and returned back to the retailer for any reason including the risk of defective units, incomplete, missing accessories, used, external blemishes. I understand that RhinoMart has provided ample areas within their site along with this pre-checkout requirement of accepting these risks before proceeding to payment of said goods or my current order. I agree to assume full responsibility should the items I'm purchasing here arrive in any one of the previous mentioned conditions. If for any reason, once I've placed an order, and once the payment has been made, I acknowledge and agree to pay a restocking fee of 20% should the order be canceled even prior to shipping to cover RhinoMart's expenses to pull, and prep the shipment. I agree to hold RhinoMart harmless in the event that I click this checkbox requirement but did not properly read this agreement and proceeded to pay and complete this transaction, and agree that I have hastily acted with personal neglect and do not hold RhinoMart responsible. I have read RhinoMart’s shipping and returns policy and I agree to pay unconditionally for all shipping costs.
I agree to resolve any and all disputes directly with Rhino Mart, Inc according to Rhino Mart’s Shipping and Returns Policy. I have read and agree with their terms and procedures should a returns or dispute arise. I understand that should issues of shortage or product attributes or product qualities arise, I will be the responsible party to cover at my expense all necessary deliveries to and from Rhino Mart’s shipping points.
Will Call / Self Pickup
All will call or self pickup orders can be subject to freight charges as some of the items are not located in our Chino, CA Warehouse and must be shipped directly from product origin.
Jurisdiction and Venue
Should any dispute arise out of any transactions with RhinoMart, Inc., I agree that exclusive jurisdiction and venue for any litigation arising out of such dispute shall be in
Los Angeles County
, California . I agree that should a dispute arise, RhinoMart will be entitled to attorney, court, and filing costs incurred throughout the process including interest. |
